RESOLUTION NO. RS2005-911

A resolution accepting $8,470.37 in compromise and settlement of The Metropolitan Government of Nashville and Davidson County's property damage claim against Ledford Tire and Trucking.

Whereas, on January 24, 2005, on I-40 East near mile marker 207, a road repair crew was diverting traffic into the far left lane. As a result, traffic slowed and eventually stopped. A Metro Action Commission truck was struck in the rear by a tractor trailer which was following too closely; and

Whereas, after investigation, the Metropolitan Department of Law believes that the settlement listed in Section 1 is fair and reasonable and recommends that the property damage claim be compromised and settled in the amount of $8,470.37 and that these funds be deposited into the appropriate fund and account as determined by the Department of Finance.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. The Metropolitan Department of Law is authorized to accept the amount of $8,470.37 in compromise and settlement of the property damage claim against Ledford Tire and Trucking and to deposit said funds into the appropriate fund and account as determined by the Department of Finance.

Section 2. This resolution shall take effect from and after its adoption, the welfare of the Metropolitan Government of Nashville and Davidson County requiring it.
