RESOLUTION NO. RS2005-889

A resolution requesting the Solid Waste Region Board of the Metropolitan Government of Nashville and Davidson County to recommend approval of the Newsom Pointe land reclamation project to the Tennessee Department of Environment and Conservation, Division of Solid Waste.

WHEREAS, the Newsom Station/Bellevue area is experiencing rapid growth and development; and

WHEREAS, an inactive rock quarry currently exists on certain property on McCrory Lane near the intersection of McCrory Lane and Highway 70; and

WHEREAS, due to continuing residential development, an inactive quarry increasingly becomes a blight on the community creating an attractive nuisance and danger for children and teenagers in the area; and

WHEREAS, this community supports a plan to reclaim the property by filling the quarry cavity with rock and construction and demolition debris so that, over time, the site may be redeveloped for recreational and residential uses; and

WHEREAS, new construction in this part of Metro Davidson County will generate significant amounts of debris suitable for a construction and demolition landfill; and

WHEREAS, the Solid Waste Region Board of the Metropolitan Nashville and Davidson County ("Board") on November 16, 1999, adopted a revised Solid Waste Region Plan ("Plan"); and

WHEREAS, the Plan promotes recycling and the reduction of municipal solid waste that is disposed of in Class I landfills; and

WHEREAS, the Solid Waste Region Plan appears to require the Metropolitan Council to approve the location of any new construction and demolition landfills; and

WHEREAS, reclaiming this inactive rock quarry with construction and demolition debris provides needed landfill space for area growth, reduces the amount of waste disposed of in a Class I landfill, and provides a beneficial reuse of property that has become an attractive nuisance and blight on the community.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That the Metropolitan County Council hereby goes on record as requesting the Solid Waste Region Board to approve and recommend that the Tennessee Department of Environment and Conservation issue a permit for a construction and demolition Class IV landfill on property located at 7848 McCrory lane for the period of time necessary to fill the cavity of the inactive quarry pits located on the site with construction and demolition debris in preparation of redeveloping the site for recreational and residential land uses.

Section 2. The Metropolitan Clerk is directed to send a copy of this Resolution to Billy Lynch, the Director of the Department of Public Works, and the members of the Solid Waste Region Board.

Section 3. This Resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
