RESOLUTION NO. 2005-776
A resolution approving and authorizing the Mayor to execute a revised amending agreement with the State of Tennessee Department of Transportation and CSX Transportation Inc. regarding improvements to the Demonbruen Street Bridge in accordance with Federal Project No. BR-STP-3249(2).
WHEREAS, pursuant to Ordinance No. BL2004-310, the Metropolitan Council approved a contract ("Contract") between the Metropolitan Government and the State of Tennessee Department of Transportation ("TDOT") for the management, funding, and related matters for the improvements necessary for the viaduct bridge on Demonbreun Street over 11th Avenue and CSX Railroad (LM 0.04), in accordance with Federal Project No. BR-STP-3249(2); and
WHEREAS, Ordinance No. BL2004-310 provided that amendments to the Contract must be approved by Resolution of the Metropolitan Council; and
WHEREAS, the parties amended their original Contract to include CSX Transportation, Inc. ("CSXT"), and more specifically address the demolition construction of the viaduct bridge, which amending Agreement No. 0610 was approved by Resolution RS2005-697 ("Amending Agreement"); and
WHEREAS, since the approval of that Amending Agreement, CSXT has requested that several changes be made, including changes as to terminology, insurance, and costs; and
WHEREAS, those changes are included on the Revised Amending Agreement, as attached hereto and incorporated herein.
NOW THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:
SECTION 1: That the revised amending Agreement between The Metropolitan Government of Nashville and Davidson County, CSX Transportation Inc., and the State of Tennessee, Department of Transportation, concerning Federal Project No: BR-STP-3249(2), rehabilitation or reconstruction of the Demonbruen Street Bridge over 11th Avenue and CSX Railroad (LM 0.04), attached hereto and incorporated herein, is hereby approved, and the Mayor is authorized to execute the same.
SECTION 2: That this Resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
