RESOLUTION NO. 2005-770

A resolution requesting the Davidson County Delegation to the Tennessee General Assembly to introduce and enact the necessary legislation to erase outstanding traffic tickets for moving violations more than five years old from a person's driving record for the purpose of reinstating their driving privileges.

WHEREAS, state law provides that any person whose license has been suspended, cancelled, or revoked cannot obtain a Tennessee driver license until such person has complied with all requirements for reinstatement; and

WHEREAS, certain Tennessee residents have had their driving privileges suspended as a result of numerous traffic citations or unpaid court costs and fines for moving violations; and

WHEREAS, such Tennessee residents often need a driver license in order to travel to and from work to support themselves and their families; and

WHEREAS, it is fitting and proper that the Tennessee General Assembly take the action necessary to allows these residents who have had their driving privileges suspended or revoked as a result of moving violations to obtain a Tennessee driver license if the moving violations are more than five years old.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That the Metropolitan County Council hereby goes on record as requesting the Davidson County Delegation to the Tennessee General Assembly to introduce and enact the necessary legislation to erase outstanding traffic tickets for moving violations more than five years old from a person's driving record for the purpose of reinstating their driving privileges.

Section 2. That the Metropolitan Clerk is directed to send a copy of this Resolution by U.S. mail or electronic mail to each member of the Davidson County Delegation to the Tennessee General Assembly.

Section 3. This Resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
