RESOLUTION NO. RS2005-707

A resolution requesting the Metropolitan Historic Zoning Commission to allow businesses on Second Avenue to maintain their outside ATM machines, and encouraging the Commission to develop design guidelines for outside ATM machines in historic districts.

WHEREAS, the Metropolitan Historic Zoning Commission has the responsibility for adopting design guidelines for historic overlay districts, and for determining the appropriateness of the exterior architectural design and features of structures within historic overlay districts; and

WHEREAS, it has been determined that certain automatic teller machines (ATMs) along Second Avenue North are currently in violation of the Second Avenue historic overlay district; and

WHEREAS, these ATMs provide a vital portion of the revenues received by businesses located along Second Avenue; and

WHEREAS, many of these businesses on Second Avenue rely on the patronage of tourists, which frequently use the outside ATM machines; and

WHEREAS, although the Metropolitan Council has the authority to adopt and repeal historic zoning overlays, the Council recognizes that the Historic Zoning Commission is best suited for making decisions regarding appropriate design guidelines for historic structures; and

WHEREAS, it is fitting and proper that the ATM machines on Second Avenue be allowed to remain, and that the Historic Zoning Commission adopt appropriate design guidelines for future outside ATM machines in historic zoning overlay districts.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That the Metropolitan County Council hereby goes on record as requesting the Metropolitan Historic Zoning Commission to allow businesses on Second Avenue to maintain their outside ATM machines, and encouraging the Commission to develop design guidelines for outside ATM machines in historic districts.

Section 2. That the Metropolitan Historic Zoning Commission is further requested to respond to the Council as to the feasibility of and/or action taken in compliance with the request stated in Section 1 hereof not later than sixty (60) days from the date of adoption of this Resolution.

Section 3. That the Metropolitan Clerk is directed to send a copy of this Resolution by United States mail or electronic mail to each member of the Metropolitan Historic Zoning Commission.

Section 4. This Resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
