A resolution approving and authorizing the Mayor to execute an amending agreement with the State of Tennessee Department of Transportation and CSX Transportation Inc. regarding improvements to the Demonbreun Street Bridge in accordance with Federal Project No. BR-STP-3249(2).

WHEREAS, pursuant to Ordinance No. BL2004-310, the Metropolitan Council approved a contract ("Contract") between the Metropolitan Government and the State of Tennessee Department of Transportation ("TDOT") for the management, funding, and related matters for the improvements necessary for the viaduct bridge on Demonbreun Street over 11th Avenue and CSX Railroad (LM 0.04), in accordance with Federal Project No. BR-STP-3249(2); and

WHEREAS, Ordinance No. BL2004-310 provided that amendments to the Contract must be approved by resolution of the Metropolitan Council; and

WHEREAS, the parties wish to amend their original Contract to include CSX Transportation, Inc. ("CSXT"), and more specifically address the demolition construction of the viaduct bridge, as set forth in Agreement No. 0610 attached hereto.

NOW THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

SECTION 1: That the amending Agreement No. 0610 between The Metropolitan Government of Nashville and Davidson County, CSX Transportation Inc., and the State of Tennessee, Department of Transportation, concerning Federal Project No: BR-STP-3249(2), rehabilitation or reconstruction of the Demonbruen Street Bridge over 11th Avenue and CSX Railroad (LM 0.04), attached hereto and incorporated herein, is hereby approved, and the Mayor is authorized to execute the same.

SECTION 2: That this Resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
