A resolution approving contract number 050204 with the State of Tennessee, Department of Transportation, for the State Industrial Access Road Serving Purity Dairies Inc. project, relocating Expressway Park Drive, pursuant to the Industrial Highway Act of 1959 (PIN No. 106945.00).

Whereas, the Industrial Highway Act of 1959 authorizes the Tennessee Department of Transportation to contract with cities and counties for the construction and maintenance of Industrial Highways to provide access to industrial areas and to facilitate the development and expansion of industry within the State of Tennessee; and

Whereas, Purity Dairies Inc. is planning to construct a cooler building adjacent to its present facilities on Expressway Park Drive; and

Whereas, Resolution No. RS2005-1031 approved an application to the State of Tennessee, Department of Transportation, for assistance in construction and completion of an industrial access highway, under the provisions of the Industrial Highway Act of 1959; and

Whereas, it is to the benefit of the citizens of the Metropolitan Government of Nashville and Davidson County that this contract be approved.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That the contract by and between the State of Tennessee, Department of Transportation, and The Metropolitan Government of Nashville and Davidson County, for the State Industrial Access Road Serving Purity Dairies Inc. project, relocating Expressway Park Drive, pursuant to the Industrial Highway Act of 1959, as attached hereto and incorporated herein, is hereby approved, and the Metropolitan Mayor is hereby authorized to execute the same.

Section 3. That this resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
