RESOLUTION NO. RS2005-1032

A resolution approving the exercise of option agreements for the purchase of various properties located along Seven Mile Creek, for Water & Sewerage Services Department Project No. 02-D-149B (Proposal No. 2002M-111U-12).

WHEREAS, it is in the public interest for the Metropolitan Government to acquire certain flood-prone properties; and,

WHEREAS, the properties ("Properties") shown on Map 147-07-0, Parcel 012.00 and Map 162-10-0 Parcel 202.00 (described on Exhibits A and B hereto) are flood-prone; and,

WHEREAS, Section 2.24.250(F) of the Metropolitan Code of Laws provides:

"Where land in fee simple is being purchased for purposes other than for rights-of-way for highways, streets, roads, alleys and other places for vehicular traffic, the Director of Public Property shall negotiate for the purchase of such property and seek to obtain from the owner an option to sell to the Metropolitan Government at a fixed price subject to the approval of the Metropolitan Council by resolution, and no purchase shall be consummated until it has been so approved by the metropolitan council"; and,

WHEREAS, pursuant to the terms of the documents collectively attached as Exhibit C to this resolution, options permitting the Metropolitan Government to purchase the Properties have been obtained; and,

WHEREAS, the Metropolitan Government has received a $1,062,562 federal grant and a $133,967 state grant to fund a substantial part of the purchase of the Properties; and,

WHEREAS, the purchase of the Properties, identified as Water & Sewerage Services Department Project No. 02-D-149B, Seven Mile Creek Buyout, has been funded under Capital Improvements Budget No. 02DG0013 and approved by the Metropolitan Planning Commission on October 29, 2002, Proposal Number 2002M-111U-12.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

SECTION 1. The Director of Public Property, or his designee, is hereby authorized to exercise the purchase options attached hereto as Exhibit C and incorporated herein, and to execute such documents as may be necessary to effect the acquisition of the Properties by the Metropolitan Government.

SECTION 2. This Resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
