RESOLUTION NO. RS2004-652

A resolution requesting the Davidson County Delegation to the Tennessee General Assembly to introduce and enact the necessary legislation to allow Tennessee residents who have had their driving privileges suspended in other states for moving violations to be eligible to obtain a Tennessee driver license if such prior moving violations are more than three years old.

WHEREAS, the Rules of the Tennessee Department of Safety Division of Driver License Issuance provide that applicants are ineligible to receive a driver license in Tennessee if their privilege to drive is under suspension, revocation, cancellation, or denial in any other state; and

WHEREAS, state law provides that any person whose license has been suspended, cancelled, or revoked cannot obtain a Tennessee driver license until such person has complied with all requirements for reinstatement; and

WHEREAS, certain new Tennessee residents have had their driving privileges suspended in another state as a result of unpaid court costs and fines or moving violations; and

WHEREAS, such new Tennessee residents often need a driver license in order to travel to and from work to support themselves and their families; and

WHEREAS, it is fitting and proper that the Tennessee General Assembly take the action necessary to allows these new Tennessee residents who have had their driving privileges suspended or revoked in another state as a result of moving violations to obtain a Tennessee driver license if the moving violations are more than three years old and such residents have a clean Tennessee driving record.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That the Metropolitan County Council hereby goes on record as requesting the Davidson County Delegation to the Tennessee General Assembly to introduce and enact the necessary legislation to allow Tennessee residents who have had their driving privileges suspended in other states for moving violations to be eligible to obtain a Tennessee driver license if such prior moving violations are more than three years old.

Section 2. That the Metropolitan Clerk is directed to send a copy of this Resolution by U.S. mail or electronic mail to each member of the Davidson County Delegation to the Tennessee General Assembly.

Section 3. This Resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
