A resolution authorizing the Metropolitan Department of Law to compromise and settle the claim of John and Susie Yoon against The Metropolitan Government of Nashville and Davidson County for the amount of $41,827.97 and directing that this amount be paid from the Self-Insured Liability fund.

Whereas, on October 19, 2004, claimants John and Susie Yoon, sustained property damage caused by water and sewage backing up into their property known as Murfreesboro Road Office Plaza. Emergency water extraction and sanitization of affected areas was provided by Servpro of South Nashville at the cost of $41,827.97.

Whereas, after investigation, the Metropolitan Department of Law believes that the settlement listed in Section 1 is fair and reasonable and in the best interest of the Metropolitan Government, and recommends that this claim be compromised and settled for the amount of $41,827.97 to be paid to Servpro of South Nashville, and that this amount be paid from the Self-Insured Liability Fund.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. The Metropolitan Department of Law is authorized to compromise and settle the claim of John and Susie Yoon for the amount of $41,827.97 and that said amount should be paid from the Self-Insured Liability Fund.

Section 2. This resolution shall take effect from and after its adoption, the welfare of the Metropolitan Government of Nashville and Davidson County requiring it.
