RESOLUTION NO. RS2004-618
A resolution approving an agreement with Red River Service Corporation for municipal solid waste collection services.
WHEREAS, pursuant to section 2.01 of the Metropolitan Charter, the Metropolitan Government has the authority to “collect and dispose of garbage and other refuse within the urban services district;” and
WHEREAS, pursuant to its authority under section 2.01 of the Metropolitan Charter and the terms of the agreement (the “Agreement”) attached hereto as Exhibit A, the Metropolitan Government proposes to contract with Red River Service Corporation to provide municipal solid waste collection services within the urban services district; and
WHEREAS, Section 4.12.220 of the Metropolitan Code of Laws calls for Council approval by Resolution of certain contracts “providing for the collection, transportation and/or disposal of solid waste;” and
WHEREAS, approval of the Agreement will benefit the citizens of Davidson County by providing an economical and efficient means of collecting municipal solid waste.
NOW THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:
SECTION 1: The Agreement between The Metropolitan Government of Nashville and Davidson County and Red River Service Corporation, attached hereto and incorporated herein, is hereby approved.
SECTION 2: Any amendments, renewals, or extension of the terms of the Agreement must be approved by Resolution of the Metropolitan Council.
SECTION 3: This Resolution shall take effect from and after its adoption, the welfare of the Metropolitan Government of Nashville and Davidson County requiring it.
