RESOLUTION NO. RS2004-605

A resolution requesting the Davidson County Delegation to the Tennessee General Assembly to consider introducing and enacting the necessary legislation to require a person to have a valid driver license and proof of financial responsibility before purchasing a motor vehicle.

WHEREAS T.C.A. §55-50-301 provides that no person shall drive a motor vehicle upon public roads in Tennessee unless such person has a valid driver license; and

WHEREAS, T.C.A. §55-12-139 provides that every vehicle driven upon public roads in Tennessee must be in compliance with the financial responsibility law, which requires proof of insurance or self-insured status; and

WHEREAS, state law currently does not require a person seeking to purchase a motor vehicle to have a valid driver license or proof of insurance; and

WHEREAS, requiring purchasers of motor vehicles to have a valid driver license and proof of insurance would greatly assist in ensuring that persons driving on the roads of our state are familiar with the traffic laws and are financially responsible to compensate other drivers for any accident they may cause.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That the Metropolitan County Council hereby goes on record as requesting the Davidson County Delegation to the Tennessee General Assembly to consider introducing and enacting the necessary legislation to require a person to have a valid driver license and proof of financial responsibility before purchasing a motor vehicle.

Section 2. That the Metropolitan Clerk is directed to send a certified copy of this Resolution to each member of the Davidson County Delegation to the General Assembly.

Section 3. This Resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
