A resolution authorizing the Metropolitan Department of Law to compromise and settle the claim of Margaret Burke against The Metropolitan Government of Nashville and Davidson County for the amount of $16,571.54, and to compromise and settle the property damage claims in the amount of $10,897.30 to The Hartford Insurance Company, totaling $27,468.84, and directing that this amount be paid from the Self-Insured Liability Fund.

Whereas, on March 26, 2004, claimant Margaret Burke sustained personal injuries when the vehicle in which she was a passenger was struck by a General Hospital vehicle which made an unsafe lane change, causing the claimant’s vehicle and trailer to strike a guardrail, thus causing the claimant personal injuries and property damage; and,

Whereas, The Hartford Insurance Company, Ms. Burke’s automobile liability insurance company, paid for the property damage and medical payments for Ms. Burke’s care; and,

Whereas, after investigation, the Metropolitan Department of Law believes that the settlement listed in Section 1 is fair and reasonable and in the best interest of the Metropolitan Government, and recommends that this claim be compromised and settled for the amount of $16,571.54 to Margaret Burke, and $10,897.30 to the Hartford Insurance Company, totaling $27,468.84, and that this amount be paid from the Self-Insured Liability Fund.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. The Metropolitan Department of law is authorized to compromise and settle the claims of Margaret Burke for the amount of $16,571.54, and The Hartford Insurance Company for the amount of $10,897.30, totaling $27,468.84, and that said amount should be paid from the Self-Insured Liability Fund.

Section 2. This resolution shall take effect from and after its adoption, the welfare of the Metropolitan Government of Nashville and Davidson County requiring it.
