RESOLUTION NO. RS2004-575
A resolution setting a public hearing for a proposed amendment to the Capitol Mall Redevelopment Plan.
WHEREAS, a Capitol Mall Redevelopment Plan consisting of a text, exhibit, and maps currently exists as previously approved by Ordinance Number 82-845, and subsequently amended by the adoption of Ordinance Nos. 87-1695, 91-1567, 93-774, 97-755, 98-1187 and 2002-1033; and
WHEREAS, the Metropolitan Development and Housing Agency desires to amend the Capitol Mall Redevelopment Plan; and
WHEREAS, the project is to be undertaken by the Metropolitan Development and Housing Agency in accordance with and in furtherance of the objectives of Tennessee Code Annotated, Sections 13-20-201 through 209; and
WHEREAS, Tennessee Code Annotated, section 13-20-203, requires a public hearing on the amendment of any redevelopment plan prior to final approval being given by the Metropolitan Council; and
WHEREAS, The proposed amendment will be referred by the Metropolitan Development and Housing Agency to the Metropolitan Council for its review and approval; and
WHEREAS, a legal notice stating the date, time and place of said public hearing must be published in each newspaper of general circulation in the locality where the project is situated.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY TENNESSEE:
Section 1. That at the meeting of the Metropolitan Council to be held on Tuesday, December 7, 2004, at 7:00 p.m. in the Metropolitan Council Chamber on the first floor of Metro City Hall (225 Polk Avenue), the Council shall conduct a public hearing relative to amending the Capitol Mall Redevelopment Plan in the manner required by law, at which hearing any person or organization desiring to be heard regarding the proposed plan will be afforded such an opportunity.
Section 2. That the Metropolitan Clerk is hereby directed to have published in The Tennessean, being the daily newspaper of general circulation in Nashville, Tennessee, in the issues of November 22, November 29 and December 6, 2004, a legal notice declaring a public hearing will be held at the time and place aforesaid in the manner prescribed by law after approval of said legal notice by the Metropolitan Attorney.
Section 3. That the Metropolitan Development and Housing Agency be and is hereby authorized and directed to give written notice of the public hearing to at least one of the owners or at least one of the occupants of each parcel of property within the area affected by the proposed plan, as required by law.
Section 4. That this Resolution shall take effect from and after its adoption, the welfare of the Metropolitan Government of Nashville and Davidson County requiring it.

Resolution No. RS2004-575
Mr. President:
I move to amend Resolution No. RS2004-575 by deleting Section 2 in its entirety and substituting in lieu thereof the following new Section 2:
“Section 2. That the Metropolitan Clerk is hereby directed to have published in the November 22, November 29 and December 6, 2004, issues of The Tennessean and The City Paper, being daily newspapers of general circulation in Nashville, Tennessee, and in the November 19, November 26, and December 3, 2004, issues of Nashville Pride, a legal notice declaring that a public hearing will be held at the time and place aforesaid in the manner prescribed by law after approval of said legal notice by the Metropolitan Attorney.”
