A resolution initiating the cancellation of the existing Planned Unit Development for property located at 3140 Hamilton Church Road (8.46 acres), for the purpose of waiving the zoning application fee.

WHEREAS, Section 17.40.740 of the Metropolitan Code of Laws, the Zoning Ordinance of the Metropolitan Government, provides in part that zoning application fees shall be waived for any large area rezonings initiated by the Metropolitan Council to implement the general plan; and

WHEREAS, the Council desires to initiate the cancellation of the existing Planned Unit Development for property located at 3140 Hamilton Church Road, as being Property Parcel No. 236 as designated on Map150 of the Official Property Identification Maps of The Metropolitan Government of Nashville and Davidson County, for the purpose of waiving the zoning application fee in accordance with Section 17.40.740.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That the Metropolitan County Council hereby initiates the cancellation of the existing Planned Unit Development, property located at 3140 Hamilton Church Road (8.46 acres), as being Property Parcel No. 236 as designated on Map150 of the Official Property Identification Maps of The Metropolitan Government of Nashville and Davidson County, for the purpose of waiving the zoning application fee.

Section 2. The Metropolitan County Council hereby determines that the cancellation of said Planned Unit Development satisfies the requirements of Section 71.40.740.B.

Section 3. This Resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
