A resolution requesting the Metropolitan Police Department to examine the feasibility of implementing an automated traffic enforcement program through the use of cameras at busy intersections.

WHEREAS, since the appointment of Chief of Police Ronal Serpas, the Police Department has made a concerted effort to increase enforcement of Metro’s traffic laws; and

WHEREAS, it has been proven that increased enforcement of traffic laws results in fewer traffic accidents and helps protect the safety of all motorists; and

WHEREAS, many cities across the country, including Germantown, Tennessee, have implemented automated traffic enforcement programs by using digital and video cameras to catch motorists who are speeding and running red lights; and

WHEREAS, the Tennessee Attorney General has opined that local governments in Tennessee have the authority under their inherent police power to utilize automated cameras to enforce traffic ordinances; and

WHEREAS, it is fitting and proper that the Metropolitan Police Department examine the feasibility of using such automated technology in Nashville as an additional traffic law enforcement tool.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That the Metropolitan County Council hereby goes on record as requesting the Metropolitan Police Department to examine the feasibility of implementing an automated traffic enforcement program through the use of cameras at busy intersections.

Section 2. That the Metropolitan Police Department is further requested to respond to the Council as to the feasibility of the request stated in Section 1 hereof not later than sixty (60) days from the date of adoption of this Resolution.

Section 3. That the Metropolitan Clerk is directed to send a certified copy of this Resolution to Chief of Police Ronal Serpas.

Section 4. That this Resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
