SUBSTITUTE RESOLUTION NO. RS2004-533

A resolution requesting the Metropolitan Department of Codes Administration to examine the feasibility of having inspectors in the Property Standards Division work certain night and weekend shifts, and to consider the safety of such inspectors working at night.

WHEREAS, the Metropolitan Department of Codes Administration is responsible for enforcing the provisions of the property standards code; and

WHEREAS, in order to enforce the property standards code, the Department of Codes Administration sends inspectors into the field to inspect property and cite violators; and

WHEREAS, certain violations of the property standards code regarding exterior property areas, such as the parking of motor vehicles in yards, are often not visible during normal daytime working hours; and

WHEREAS, having property standards code inspectors work night and weekend shifts would increase the Department’s ability to cite violators and increase the quality of life of the residents of Nashville and Davidson County; and

WHEREAS, it is fitting and proper that the Department of Codes Administration examine the feasibility of having property standards code inspectors work in the evenings and weekends, while taking into consideration the safety of the inspectors.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That the Metropolitan County Council hereby goes on record as requesting the Metropolitan Department of Codes Administration to examine the feasibility of having inspectors in the Property Standards Division work certain night and weekend shifts, and to consider the safety of such inspectors working at night.

Section 2. That the Metropolitan Department of Codes Administration is further requested to respond to the Council as to the feasibility of the request stated in Section 1 hereof not later than sixty (60) days from the date of adoption of this Resolution.

Section 3. That the Metropolitan Clerk is directed to send a certified copy of this Resolution to Terry Cobb, the Director of the Department of Codes Administration.

Section 4. That this Resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
