A resolution authorizing the Metropolitan Mayor to enter into Supplemental Agreement No. 500,502, with Nashville and Eastern Railroad Corporation, allowing the Department of Water and Sewerage Services to increase the rental fee paid for the sewer line at M.P. O.H. 0.98, Nashville, Tennessee.

WHEREAS, Nashville and Eastern Railroad Corporation the “Railroad” owns and maintains railroad tracks in Davidson County and some surrounding counties; and

WHEREAS, the Metropolitan Department of Water and Sewerage Services needs to retain their existing lease in the railroad right-of-way located at M.P. O.H. 0.98, Nashville, Tennessee for the purpose of a sewer line; and,

WHEREAS, the railroad seeks to increase the annual rent from $51.84 to $54.95, to be further adjusted every three years thereafter, a copy of which is attached hereto as Exhibit A, as stated in Supplemental Agreement No. 500,502; and

WHEREAS, Metropolitan Ordinance No. 98-1364 authorizes all future agreements to be processed by resolution.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

SECTION 1: That Supplemental Agreement No. 500,502, is approved and incorporated herein, and the Metropolitan Mayor is authorized to execute the same.

SECTION 2: That this Resolution shall take effect from and after its adoption, the welfare of the Metropolitan Government of Nashville and Davidson County requiring it.
