A resolution approving an amendment to a contract between The Metropolitan Government of Nashville and Davidson County and Acton Mobile Industries for the lease of mobile offices and related items.

Whereas, in April, 2002, Acton Mobile Industries entered into contract number 14741 (“contract”) with the Metropolitan Government for the lease of mobile offices and related items, including ramps, steps, and connector, which contract was approved by RS2002-1001; and

Whereas, the parties wish to amend that contract as set forth in Amendment No. One (“Amendment”), attached hereto as Exhibit A, to extend the contract until September 30, 2005, with an additional option to renew until March 30, 2007; and

Whereas, Metropolitan Code of Laws Section 5.04.020 provides that all leases of equipment shall be approved by resolution of the Metropolitan Council if the annual expenditure for said lease exceeds five thousand dollars ($5,000) per year; and

Whereas, the annual expenditure to lease mobile offices pursuant to this contract, as amended, will exceed five thousand dollars ($5,000) per year; and,

Whereas, it is deemed to be in the best interest of the Metropolitan Government to approve the Amendment.

Now, therefore, be it resolved by the Council of The Metropolitan Government of Nashville and Davidson County:

Section 1. That the lease of mobile offices by The Metropolitan Government of Nashville and Davidson County from Acton Mobile Industries, pursuant to the terms of the attached Amendment, a copy of which is attached hereto and incorporated herein, is hereby approved.

Section 2. That this resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
