RESOLUTION NO. RS2004-459
A resolution authorizing the Metropolitan Government to enter into an Interlocal
Agreement with the West Wilson Utility District to purchase drinking water
in an emergency or special need.
WHEREAS, Metropolitan Government provides safe, sanitary water supply to
an area in eastern Davidson County; and
WHEREAS, West Wilson Utility District provides safe, sanitary water supply to an area of west Wilson County lying generally to the north of Interstate 40; and
WHEREAS, The Interlocal Cooperation Act, Tennessee Code Annotated, Section 12-9-101 et seq., authorizes public agencies to enter into agreements for joint undertakings, subject to approval of Council; and
WHEREAS, it is in the parties’ interest to enter into an agreement whereby the Metropolitan Government and West Wilson Utility District may purchase drinking water from the water supply system of the other during a time of emergency or special need; and
WHEREAS, the Interlocal Agreement attached hereto as Exhibit A sets forth the terms governing each party’s purchase of water from the other.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY.
SECTION 1. The Interlocal Agreement, with the West Wilson Utility District, attached hereto as Exhibit A and incorporated herein, is hereby approved, and the Metropolitan Mayor is authorized to execute the same.
SECTION 2. This resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
