RESOLUTION NO. RS2004-458

A resolution authorizing the Metropolitan Government, to enter into an Interlocal Agreement with the Old Hickory Utility District and The City of Lakewood to purchase drinking water in an emergency or special need.

WHEREAS, Metropolitan Government provides safe, sanitary water supply to an area in eastern Davidson County; and

WHEREAS, Old Hickory Utility District and The City of Lakewood provides safe, sanitary water supply to an area of Wilson County lying generally to the north of Interstate 40; and

WHEREAS, The Interlocal Cooperation Act, Tennessee Code Annotated, Section 12-9-101 et seq., authorizes public agencies to enter into agreements for joint undertakings, subject to approval by Resolution of Council; and

WHEREAS, it is in the parties’ interest to enter into an agreement whereby the Metropolitan Government, Old Hickory Utility District, and The City of Lakewood may purchase drinking water from the water supply system of the other during a time of emergency or special need; and

WHEREAS, the Interlocal Agreement attached hereto as Exhibit A sets forth terms governing each party’s purchase of water from the other.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY.

SECTION 1. The Interlocal Agreement with the Old Hickory Utility District and The City of Lakewood, attached hereto as Exhibit A and incorporated herein, is hereby approved, and the Metropolitan Mayor is authorized to execute the same.

SECTION 2. This resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
