A resolution approving a contract between The Metropolitan Government of Nashville and Davidson County and Imagistics International Inc. for the lease of copiers.

Whereas, the State of Tennessee has entered into an agreement with Imagistics International Inc. (formerly Pitney Bowes Office Systems) to lease copiers for various state departments (Contract No. 4026977); and,

Whereas, Metropolitan Code of Laws §4.12.090 (B) provides that the purchasing agent may make purchases using the provisions of contracts entered into by the State Department of General Services in compliance with Tennessee Code Annotated §12-3-1001(c); and

Whereas, Metropolitan Code of Laws Section 5.04.020 provides that all leases of equipment shall be approved by resolution of the Metropolitan Council if the annual expenditure for said lease exceeds five thousand dollars ($5,000) per year; and

Whereas, Imagistics International Inc. has executed a contract (“contract”) with the Metropolitan Government setting forth additional terms governing the lease of copiers to the Metropolitan Government; and

Whereas, the annual expenditure to lease copiers pursuant to this contract will exceed five thousand dollars ($5,000) per year; and,

Whereas, it is deemed to be in the best interest of the Metropolitan Government to approve said contract.

Now, therefore, be it resolved by the Council of The Metropolitan Government of Nashville and Davidson County:

Section 1. That the lease of copiers by The Metropolitan Government of Nashville and Davidson County from Imagistics International Inc., pursuant to the terms of the attached contract and Contract No. 4026977 between the State of Tennessee and Imagistics International Inc., copies of which are attached hereto and incorporated herein, is hereby approved.

Section 2. That this resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
