SUBSTITUTE RESOLUTION NO. RS2004-435

A substitute resolution requesting the Metropolitan Planning Commission to adopt public notification requirements in rules for consideration of subdivision applications.

WHEREAS, residents are becoming frequently and increasingly upset when subdivisions are approved by the Metropolitan Planning Commission, of which the have had little or no notice; and

WHEREAS, the Metro zoning text requires public notification on changes in land use that give notice to the public and adjacent property owners; and

WHEREAS, it is fitting and proper that the Metropolitan Planning Commission adopt similar notice requirements in handling subdivision rules to allow those adjacent neighbors notice of subdivision application, which would allow them to appear at the Planning Commission meeting and participate in this process.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. The Metropolitan County Council hereby goes on record as requesting the Metropolitan Planning Commission to adopt public mailing notification requirements similar to those contained in Section 17.40.720 of the Metropolitan Code in its rules for consideration of subdivision applications.

Section 2. The Metropolitan Clerk is directed to send a certified copy of this Resolution to the Executive Director of the Planning Department and to members of Metropolitan Planning Commission.

Section 3. The Metropolitan Planning Department and the Planning Commission are further requested to respond to the Council as to the feasibility of and/or compliance with the request stated in Section 1 not later than sixty (60) days from the adoption of this Resolution.

Section 4. This Resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
