SUBSTITUTE RESOLUTION NO. RS2004-432
A resolution requesting the Department of Water and Sewerage Services and Nashville Electric Service to submit an accountability report to the Metropolitan Council to ensure that customers are not being overcharged.
WHEREAS, pursuant to the Metropolitan Charter, the Department of Water and Sewerage Services is responsible for the operation and maintenance of all water and sanitary sewer services of the Metropolitan Government, and for the collection of all charges for such services; and
WHEREAS, the Nashville Electric Service is the provider of electric service to all of Davidson County; and
WHEREAS, certain customers of the Department of Water and Sewerage Services and Nashville Electric Service have complained about being overcharged as a result of faulty or malfunctioning meters; and
WHEREAS, in order to avoid such overcharges in the future, it is necessary that the Department of Water and Sewerage Services and Nashville Electric Service maintain a system of accountability ensuring that meters are operating properly; and
WHEREAS, it is fitting and proper that the Department of Water and Sewerage Service and Nashville Electric Service submit an accountability report to the Metropolitan Council showing the steps taken to ensure that customers are not being overcharged.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:
Section 1. That the Metropolitan County Council hereby goes on record as requesting the Department of Water and Sewerage Services and Nashville Electric Service to submit an accountability report to the Metropolitan Council to ensure that customers are not being overcharged.
Section 2. That the Metropolitan Clerk is directed to send a certified copy of this Resolution to Scott Potter, the Director of the Department of Water and Sewerage Services, and to Decosta Jenkins, the President and CEO of Nashville Electric Service.
Section 3. That the Department of Water and Sewerage Services and Nashville Electric Service are further requested to submit the accountability report requested in Section 1 hereof not later than ninety (90) days from the adoption of this Resolution.
Section 4. This Resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
