RESOLUTION NO. RS2004-418

A resolution approving an amendment to the Agreement between the Metropolitan Government of Nashville and Davidson County and Volunteer State Community College, concerning Health Insurance Portability and Accountability Act of 1996 (HIPAA) requirements.

Whereas, the Metropolitan Council by Ordinance No. BL 2003-1349 approved an affiliation agreement between the Metropolitan Government, acting by and through its Department of Fire, First Responder Program, Communications Section and Division of Emergency Ambulance and Rescue Service, and Volunteer State Community College, Gallatin, Tennessee, for the purpose of providing students enrolled in the Allied Health Education Program of the College with opportunity and experience in clinical training with the Metropolitan Government; and

Whereas, the parties desire to amend their Agreement to provide that the parties comply with the Health Insurance Portability and Accountability Act of 1996, as codified at 42 U.S.C. § 1320d; and

Whereas, Ordinance No. BL 2003-1349 provides that any amendments to the Agreement must be approved by resolution of the Metropolitan Council receiving at least twenty-one affirmative votes; and

Whereas, it is deemed to be in the best interest of the Metropolitan Government that this amendment to the Agreement be approved.

Now, therefore, be it resolved by the Council of the Metropolitan Government of Nashville and Davidson County:

Section 1. That Amendment One to the Agreement between the Metropolitan Government of Nashville and Davidson County and Volunteer State Community College, concerning HIPAA requirements, a copy of which is attached hereto and incorporated herein, is hereby approved, and the Metropolitan Mayor is authorized to execute the same.

Section 2. That this resolution shall take effect from and after its adoption, the welfare of the Metropolitan Government of Nashville and Davidson County requiring it.
