A resolution accepting $6,526.58 in partial settlement of the Metropolitan Government of Nashville and Davidson County’s property damage claim against L & G Construction Company.

Whereas, on February 12, 2003, L & G Construction Company, a subcontractor, hit and broke a 36-inch water main while working on the sidewalk at 1125 Eighth Avenue South, causing property damage; and

Whereas, after investigation, the Metropolitan Department of Law believes that the
partial settlement listed in Section 1 is fair and reasonable and recommends that the claim against L & G Construction Company be compromised and partially settled in the amount of $6,526.58 and that these funds be deposited into the appropriate fund and account as determined by the Department of Finance; and

Whereas, the Metropolitan Department of Law will seek recovery of the remaining property damage claim from the contractor.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY.

Section 1: The Metropolitan Department of Law is authorized to accept the amount of $6,526.58 in partial settlement of the property damage claim against L & G Construction Company.

Section 2: This resolution shall take effect from and after its passage, the welfare of the Metropolitan Government of Nashville and Davidson County requiring it.
