A resolution approving an amendment to a grant from the State of Tennessee, Department of Environment and Conservation, to The Metropolitan Government of Nashville and Davidson County, by and through the Department of Public Works, extending the term of the grant and providing for additional funding.

WHEREAS, the Metropolitan Government of Nashville and Davidson County, by and through the Department of Public Works, previously entered into a Grant Agreement with the State of Tennessee, Department of Environment and Conservation, pursuant to which the Metropolitan Government was awarded a grant for waste tire collection and disposal, not to exceed Four Hundred Thirty-Five Thousand Six Hundred Twenty-Five Dollars ($435,625), which Grant Agreement was approved by the Metropolitan Council by Resolution 2003-17, and which will expire on June 30, 2004; and,

WHEREAS, Amendment 1 to this Grant Agreement was approved by the Metropolitan Council by Resolution 2004-307, increasing the amount of this grant for 2003-2004 to $580,625; and,

WHEREAS, the parties wish to again amend that Grant Agreement, as provided in Amendment 2, a copy of which is attached hereto; and,

WHEREAS, Amendment 2 extends the Grant Agreement until June 30, 2005, provides for future extensions of the Grant Agreement, and provides for a grant to the Metropolitan Government for 2004-2005 in an amount not to exceed Five Hundred Eighty Thousand Six Hundred Twenty-Five Dollars ($580,625); and,

WHEREAS, it is to benefit the citizens of The Metropolitan Government of Nashville and Davidson County that this grant be accepted.

NOW, THEREFORE BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That Amendment 2 to the Grant Agreement by and between the State of Tennessee, Department of Environment and Conservation, providing for a total amount not to exceed Five Hundred Eighty Thousand Six Hundred Twenty-Five Dollars ($580,625) to The Metropolitan Government of Nashville and Davidson County for waste tire collection and disposal in 2004-2005, extending the term of the grant until June 30, 2005, and providing for future extensions, a copy of which Amendment is attached hereto and incorporated herein, is hereby approved, and the Metropolitan Mayor is authorized to execute the same.

Section 2. That the amount of this grant for fiscal year 2004/2005, not to exceed Five Hundred Eighty Thousand Six Hundred Twenty-Five Dollars ($580,625) be appropriated to the Department of Public Works in that fiscal year’s budget, based on the revenues estimated to be received and any match to be applied.

Section 3. That this resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
