RESOLUTION NO. RS2004-352

A resolution approving an amendment to a grant from the State of Tennessee, Department of Correction, to The Metropolitan Government of Nashville and Davidson County, acting through the State Trial Courts, to provide funding for drug screening of offenders.

Whereas, the State of Tennessee, Department of Correction, awarded a grant to the Metropolitan Government of Nashville and Davidson County, acting through the State Trial Courts for the implementation of a supervision and day reporting center and such grant was approved and accepted by The Metropolitan Council by ordinance (Bill No. BL2001-824); and,

Whereas, the parties have previously amended the grant agreement, as approved by resolutions of The Metropolitan Council (RS2002-924, RS2002-1191, RS2003-1382, RS2003-1568, RS2003-95, and RS2004-213); and,

Whereas, the State of Tennessee, Department of Correction, has approved additional funding in the amount of $6,250., increasing the total amount of the grant for fiscal year three (July 1, 2003 through June 30, 2004) from $839,791. to $846,041., as set forth on Amendment Seven to the Grant (Exhibit A hereto); and,

Whereas, the parties, by mutual agreement, wish to amend the contract by deleting Attachment II budget in its entirety and replacing it with a revised Attachment II budget; and,

Whereas, Bill No. BL2001-824 provided that this grant may be amended by resolution receiving 21 affirmative votes; and,

Whereas, it is deemed to be in the best interest of The Metropolitan Government that this amendment to the grant agreement be approved.

Now, therefore, be it resolved by The Council of The Metropolitan Government of Nashville and Davidson County:

Section 1. That the amendment to the Grant by and between the State of Tennessee, Department of Correction and The Metropolitan Government of Nashville and Davidson County, acting through the State Trial Courts, which amendment provides for an increase of $6,250. in funding, and for the replacement of Attachment II, a copy of which amendment is attached hereto as Exhibit A and incorporated herein by reference, is hereby approved, and the Metropolitan Mayor is authorized to execute the same.

Section 2. That this Resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
