This Second Amendment to the Contract dated as July 8, 2002, by and between The Metropolitan Government of Nashville and Davidson County, hereinafter “Metropolitan Government”, and The Child and Family Policy Center of Vanderbilt University, hereafter “Contractor”, made and entered into as of the day of , 2004, by and between Metropolitan Government and Contractor.

Whereas, the Metropolitan County Council adopted Ordinance No. BL2002-974 creating the Council’s Taskforce on Out-of-School Time and Youth Success; and

Whereas, Ordinance No. BL2002-974 authorized a contract to be entered into by Metropolitan Government and Contractor for services in developing the Council Afterschool Initiative, which contract was approved by Resolution No. RS2002-1104 adopted by the Council; and

Whereas, said Contract was amended by an amendment entered into as of December 5,2002, extending the term of the contract through June 30, 2003, which amendment was approved by Resolution No. RS2003-1311 adopted by the Council; and

Whereas, the Council now desires to extend the term of the Contract through September 30, 2004 and to provide for additional services relating to the Council Afterschool Initiative which Contractor has agreed to perform with the funds remaining from the original contract budget.

Now, Therefore, for the mutual promises and other consideration, the receipt and adequacy of which is hereby acknowledged,

1. Section 1 Duties and Responsibilities of Contractor. shall be and the same is amended by providing following additional services on behalf of the Council to achieve the following:

(1) Assisting Metropolitan Government’s Information Technology Services in providing via internet on the web page of the Council maps by council districts of out-of-school activity services available which maps were developed in this program.

(2) The Metro Council along with community children, youth, parents and other interested parties should develop a strategic plan to make out-of-school time programming, especially summer programs, affordable and accessible for every child and youth in Davidson County taking into account the sub-committee surveys administered and reported as part of the Metro Council’s Afterschool Initiative.

(3) The Metro Council should encourage the Board of Education/Dept. of Community Education to apply for all available federal 21st Century Community Learning Centers grants. The focus of the 21st Century Community Learning Centers programs, re-authorized under Title IV, Part B, of the No Child Left Behind Act of 2001, is to provide expanded academic enrichment opportunities for children attending low-performing school. Tutorial services and academic enrichment activities are designed to help students meet local and state standards in core academic subjects with particular emphasis on reading and mathematics. In addition, 21st CCLC programs provide youth development activities, drug and violence prevention programs, technology education programs, art, music and recreation programs, counseling and character education to enhance the academic components of the program. Also, services such as family literacy may be provided to families of students enrolled in the 21st CCLC.

(4) The Metro Council’s Afterschool Initiative should support efforts of the Nashville Youth Alliance and the Metro school system to work together to develop appropriate outcomes for out-of-school time programs to increase academic enhanced achievement and quality of life.

(5) Out-of-School Time Programs should incorporate best practices such as listed in “Safe and Smart: Making After-School Hours Work for Kids, June 1998”.

(a) Programs should be safe, close to home, and accessible to all children who want to participate. Accessibility barriers such as affordability, time, space and transportation must be removed.

(b) Programs should be developed and maintained in collaboration with a variety of partners. Partners must have regular opportunities to discuss surfacing issues, evaluate, and provide feedback. Potential partners include students, parents, residents, school faculty, law enforcement entities, community based organizations, civic groups, colleges, employers, cultural institutions, parks, and public officials.

(c) Academic enrichment programs must extend the learning experience from the school classroom to the after-school program by coordinating with classroom teachers and other school staff.

(d) Program staff must take the time and opportunity to establish and maintain relationships with school faculty.

2. Section 3 of the contract, as amended, is further amended by deleting the phrase “shall expire not later than June 30, 2003” and substituting in lieu thereof the phrase “shall expire not later than September 30, 2004”.

3. Exhibit A – Budget for Council Afterschool Initiative, as amended is further amended by deleting the date “June 30, 2003” and substituting in lieu thereof the date “September 30, 2004”.
