RESOLUTION NO. RS2004-341

A Resolution authorizing the Metropolitan Government to enter into Utility Relocation Contract No. 6207 with the State of Tennessee, Department of Transportation, for water and sewer distribution and collection system relocations, as part of State Project No. BRZE-1900 (18), 19107-2503-94 Knight Rd. over Whites Creek LM 2.95 and over Earthman Fort Creek LM 3.1 in Davidson County, and Metro Project No. 02-WG-109, and authorizing an agreement with the Treasury Department of the State of Tennessee.

WHEREAS, the State of Tennessee, Department of Transportation (“TDOT”), plans to construct State Project No. BRZE -1900 (18), 19107-2503-94 Knight Rd. over Whites Creek LM 2.95 and over Earthman Fort Creek LM 3.1 in Davidson County (“State project”); and

WHEREAS, Metropolitan Department of Water and Sewerage Services (“the Department”) plans to construct the utility work identified as Project No. 02-WG-109, identified in Capital Improvement Budget, No. 96 WG005 (“utility work”), and described in the attached Agreement; and

WHEREAS, it is in the interest of the Department that this utility work be carried out simultaneously with the State project; and

WHEREAS, pursuant to the terms of Utility Relocation Contract No. 6207 (attached hereto as Exhibit A) (the “Agreement”), the Metropolitan Government will be responsible for one hundred percent (100%) of the actual cost for the utility work, which cost is currently estimated to be $179,000; and

WHEREAS, pursuant to Bill No. 2000-285 and Bill No. 2001-648, agreements with TDOT pertaining to the State project may be approved by Resolution of Council.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That the Metropolitan Mayor is authorized to execute the Utility Relocation Contract No. 6207, as attached hereto as Exhibit A.

Section 2. That the Metropolitan Mayor is hereby authorized to execute any and all supplemental agreements necessary to implement the Local Government Investment Pool Program, including that attached hereto as Exhibit B.

Section 3. That this Resolution shall take effect from and after its adoption, the welfare of the Metropolitan Government of Nashville and Davidson County requiring it.
