RESOLUTION NO. RS2004-316

A resolution accepting $6,049.63 in compromise and settlement of The Metropolitan Government of Nashville and Davidson County’s property damage claim against the State of Tennessee, Tennessee Business Enterprises.

Whereas, on November 17, 2003, the snack bar located in the Criminal Justice Center, which is operated by the State of Tennessee, Tennessee Business Enterprises, had a back up in its grease trap, which in turn caused an obstruction in a main drain;

Whereas, the obstruction caused an overflow of the drain into a storage area, damaging property in the police department belonging to The Metropolitan Government of Nashville and Davidson County, and causing employees of The Metropolitan Government to expend hours remedying the situation; and

Whereas, after investigation, the Metropolitan Department of Law believes that the settlement listed in Section 1 is fair and reasonable and recommends that the property damage claim, inclusive of associated labor costs, be compromised and settled in the amount of $6049.63, and that these funds be deposited into the appropriate fund and account as determined by the Department of Finance.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1: The Metropolitan Department of Law is authorized to accept the amount of $6,049.63 in compromise and settlement of the property damage claim against the State of Tennessee, inclusive of associated labor costs, and to deposit said funds into the appropriate fund and account as determined by the Department of Finance.

Section 2: This resolution shall take effect from and after its adoption, the welfare of the Metropolitan Government of Nashville and Davidson County requiring it.
