RESOLUTION NO. RS2004-311

A resolution authorizing the Metropolitan Mayor to enter into Supplemental Agreement No. 500,289 with Nashville and Eastern Railroad Corporation, allowing the Department of Water and Sewerage Services to increase the rental fee paid for the sewer line at M.P.4.1, Nashville, Tennessee.

WHEREAS, Nashville and Eastern Railroad Corporation (the “Railroad”) owns and maintains railroad tracks in Davidson County and some surrounding counties; and

WHEREAS, the Metropolitan Department of Water and Sewerage Services needs to retain their existing lease in the railroad right-of-way located at M.P. 4.1, Nashville, Tennessee for the purpose of a sewer line; and,

WHEREAS, the railroad seeks to increase the annual rent to $81.80, to be further adjusted every three years thereafter, as stated in Supplemental Agreement No. 500,289 (a copy of which is attached hereto as Exhibit A); and

WHEREAS, This work is identified in Metro’s Capital Improvements Budget No. 96SG0005.

WHEREAS, Metropolitan Ordinance No. 98-1364 authorizes all future agreements to be approved by resolution.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

SECTION 1: That Supplemental Agreement No. 500,289, is approved and incorporated herein, and the Metropolitan Mayor is authorized to execute the same.

SECTION 2: That this Resolution shall take effect from and after its adoption, the welfare of the Metropolitan Government of Nashville and Davidson County requiring it.
