RESOLUTION NO. RS2004-310

A Resolution approving the exercise of option agreements for the purchase of various properties located along Mill Creek, for Metro Water Services Project No. 02-D-149 (Proposal No. 2002M-111U-11).

WHEREAS, it is in the public interest for The Metropolitan Government of Nashville and Davidson County to acquire certain flood-prone properties; and

WHEREAS, the properties (“Properties”) listed in Exhibit “A” as Map 119-03-0, Parcels 87, 90, 91, 92, 93, 94, and Map 119-07-0, Parcels 33, 35, 37, 38, and 40, and shown on Exhibit “B” are flood-prone; and

WHEREAS, Section 2.24.250(F) of the Metropolitan Code of Laws provides:
Where land in fee simple is being purchased for purposes other than for rights-of-way for highways, streets, roads, alleys and other places for vehicular traffic, the director of public property administration shall negotiate for the purchase of such property and seek to obtain from the owner an option to sell to the metropolitan government at a fixed price subject to the approval of the metropolitan council by resolution, and no purchase shall be consummated until it has been so approved by the metropolitan council;
and

WHEREAS, pursuant to the terms of the documents collectively attached as Exhibit “A” to this resolution, options permitting the Metropolitan Government to purchase the Properties have been obtained; and

WHEREAS, the Metropolitan Government has received a $1,062,562 federal grant and a $133,967 state grant to fund a substantial part of the purchase of the Properties; and

WHEREAS, the purchase of the Properties, identified as Metro Water Services Project No. 02-D-149, Wimpole Drive Home Buyout, has been funded under Capital Improvements Budget No. 02DG0013, approved by the Metropolitan Planning Commission on October 24, 2002, Proposal Number 2002M-112U-11, and approved by the Metropolitan Council in Ordinance BL 2002-1164.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY.

SECTION 1. The Director of Public Property, or his designee, is hereby authorized to exercise the purchase of options attached as Exhibit “A” and to execute such documents as may be necessary to effect the acquisition of the Properties by the Metropolitan Government.

SECTION 2. This Resolution shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
