RESOLUTION NO. RS2004-308

A resolution authorizing an amendment to Ordinance No. BL2002-1164, changing the “Project Description” for Seven Mile Creek Home Buyout to a total purchase of eleven homes.

WHEREAS, the Metropolitan Government of Nashville and Davidson County has determined that it is in the best interest of the community at large and it is to the benefit of the Department of Water and Sewerage Services to purchase certain flood prone property; and,

WHEREAS, by Ordinance Number 2002-1164 (the “Ordinance”), the Council of the Metropolitan Government previously authorized the securing of a grant to fund the project named Seven Mile Creek Home Buyout, in order to purchase ten homes; and,

WHEREAS, the Ordinance also provided that future projects eligible under the Federal Emergency Management Agency programs administered by the State of Tennessee may be added by Resolution to Section 1 of the Ordinance; and,

WHEREAS, as stated in Exhibit 1 hereto, Amendment # 1 to Grant #GG-03-09853-00, the Federal Emergency Management Agency, by and through the State of Tennessee, Tennessee Emergency Management Agency, has authorized the funding to purchase one additional home in the Seven Mile Creek Home Buyout, located at 305 Milner Court; and,

WHEREAS, said funding for the purchase of an additional home will increase the original grant authorized by the Ordinance by an amount of $101,625, to a total of $511,417, with an additional match required by The Metropolitan Government of $33,875.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. This Resolution amends Ordinance No. 2002-1164, Section 1, by changing the “Project Description” for Seven Mile Creek Home Buyout to a total purchase of eleven homes, to include property located at 305 Milner Court.

Section 2. This Resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
