RESOLUTION NO. RS2004-292

A resolution requesting the Metropolitan Department of Public Works and the Tennessee Department of Transportation to cease road construction on West Trinity Lane until certain safety concerns are adequately addressed.

WHEREAS, the Metropolitan Charter designates to the Department of Public Works the responsibility for the design, construction, maintenance, and repair of streets and roads within the area of the Metropolitan Government; and

WHEREAS, the Department of Public Works has entered into an agreement with the Tennessee Department of Transportation for a road construction project on West Trinity Lane; and

WHEREAS, various safety issues have arisen regarding the road construction project on West Trinity Lane, including the lack of barriers, signage, and flagmen directing traffic; and

WHEREAS, in order to protect the safety of the motoring public, it is fitting and proper that the Department of Public Works and the Tennessee Department of Transportation stop road construction on West Trinity Lane until these safety concerns have been adequately addressed and remedied.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That the Metropolitan County Council hereby goes on record as requesting the Metropolitan Department of Public Works and the Tennessee Department of Transportation to cease road construction on West Trinity Lane until certain safety concerns are adequately addressed.

Section 2. That the Metropolitan Clerk is directed to send a certified copy of this Resolution to Billy Lynch, the Director of the Department of Public Works and to Gerald Nicely, the Commissioner of the Tennessee Department of Transportation.

Section 3. This Resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
