RESOLUTION NO. RS2004-267

A Resolution authorizing the Metropolitan Government to enter into Supplement #1 to Utility Relocation Contract No. 5844 with the State of Tennessee, Department of Transportation, for Distribution and Collection System Relocations, said construction being necessary as part of State Project No. STP-M-5333 (1), 19958-2732-54,Gateway Blvd. (Franklin Street) from 0.01 km West of 4th Ave. South to 0.4 km West of 1st Ave. South, and located in Davidson County, Tennessee; and Metro Project Nos. 99-WG-177 and 99-SG-182, and to enter into an agreement with the Treasury Department of the State of Tennessee.

WHEREAS, the Tennessee Department of Transportation is constructing State Project No. STP-M-5333 (1), 19958-2732-54, Gateway Blvd. (Franklin Street) hereafter the “utility relocation; and

WHEREAS, Resolution No. 2002-981 approved the original utility relocation Contract No. 5844 between the Metropolitan Government and the Tennessee Department of Transportation; and

WHEREAS, The Metropolitan Government is authorized by Ordinance No. 2000-286 to enter, by resolution, into Utility Relocation Contract No. 5844 with the Tennessee Department of Transportation; and

WHEREAS, the utility relocation work is identified in METRO’S CAPITAL IMPROVEMENTS BUDGET No. 96WG0005.

WHEREAS, Supplement #1 to Contract No. 5844 will increases the estimated cost to the Metropolitan Government, Department of Water and Sewerage Services, for the utility relocation by $60,570.25, to a total of $308,837.89; and

WHEREAS, Metro will make application to participate in the Local Government Investment Pool which allows the Treasury to accept and deposit Metro’s pro rata share, with the State of Tennessee for temporary involvement as an alternative for funding by the Department of Transportation with Metro’s share in the Investment Pool.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

SECTION 1: Supplement #1 to Utility Relocation Contract No. 5844 with the Tennessee Department of Transportation, attached hereto as Exhibit A, and incorporated herein, is hereby approved, and the Metropolitan Mayor is authorized to execute the same.

SECTION 2: That the Metropolitan Mayor is hereby authorized to execute any and all supplemental agreements necessary to implement the Local Government Investment Pool Program, including the agreement attached hereto as Exhibit B.

SECTION 3: That any and all contracts or amendments to contracts in connection with the subject utility relocation must be ratified by resolution of the Metropolitan Council prior to execution by the Metropolitan Mayor.

SECTION 4: That this Resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
