RESOLUTION NO. RS2004-266

A resolution authorizing the Metropolitan Government to enter into an interlocal agreement with the City of Oak Hill to fund an evenly divided share of the costs for milling Tyne Boulevard in both municipalities.

WHEREAS, the Metropolitan Government and the City of Oak Hill have both received a bid from Civil Construction of Franklin, Tennessee to conduct the milling of Tyne Boulevard in both municipalities; and

WHEREAS, the Metropolitan Government has entered into a contract with Civil Construction; and

WHEREAS, it is estimated that the milling will cost $91,000, and the cost is to be evenly divided between Oak Hill and the Metropolitan Government; and

WHEREAS, Tennessee Code Annotated, Section 12-9-104(a)(2)(b) authorizes this agreement to be approved by a resolution of the municipalities; and

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY.

SECTION 1. The Mayor of the Metropolitan Government is hereby authorized to execute an interlocal agreement, Exhibit 1, with the City of Oak Hill on behalf of the Metropolitan Government.

SECTION 2. That the parties to this interlocal agreement each agree to pay one-half of the total amount invoiced for the subject milling work by Civil Construction. The maximum amount that can be paid under the agreement by the Metropolitan Government is $47,775.

SECTION 3. This resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
