A resolution requesting the Mayor’s Office and all departments and agencies of the Metropolitan Government to create a program to provide incentives for persons to report unsafe conditions in the roadway.

WHEREAS, on April 6, 2004, the Metropolitan Council adopted Resolution No. RS2004-245 approving the settlement of a lawsuit against the Metropolitan Government in which the plaintiff involved in a motor vehicle accident alleged that the Metropolitan Government was negligent in failing to properly maintain a stop sign at an intersection that had possibly been down for at least a month prior to the accident; and

WHEREAS, although many Metropolitan Government employees are instructed to report unsafe conditions they find while on patrol or driving designated routes, there is no set government-wide program to provide incentives to such employees or to citizens to report unsafe conditions; and

WHEREAS, an incentive program could be easily developed to encourage employees and citizens to report such unsafe conditions in the Metro roadways and right-of-ways as street lights out, traffic signals not working properly, downed stop signs, and pot holes; and

WHEREAS, it is fitting and proper that a program be created to educate employees and citizens about how to report unsafe conditions and to provide incentives to private citizens and to Metropolitan Government employees on regular patrol or driving designated routes to report such unsafe conditions.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That the Metropolitan County Council hereby goes on record as requesting the Mayor’s Office and all departments and agencies of the Metropolitan Government to create a program to provide incentives for persons to report unsafe conditions in the roadway. Such program should include an educational component to inform employees and citizens about how to report unsafe conditions.

Section 2. The Metropolitan Clerk is directed to send a certified copy of this Resolution to Mayor Bill Purcell and to the director of each of the departments and agencies of the Metropolitan Government.

Section 3. This Resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
