RESOLUTION NO. RS2004-242

A resolution authorizing the compromise and settlement of the lawsuit of Jerry Hensley and Sue Hensley as surviving next of kin of Jeffrey Hensley against the Metropolitan Government for the amount of sixty-two thousand five hundred dollars ($62,500) and directing that this amount be paid out of the Judgment and Losses Fund.

Whereas, Jerry and Sue Hensley are the surviving parents of Jeffrey Hensley of Davidson County, Tennessee; and,

Whereas, Jeffrey Hensley was shot and killed by Metropolitan Police Officer James Curtis on October 10, 2001 following a vehicular pursuit; and,

Whereas, Mr. and Mrs. Hensley filed suit against the Metropolitan Government and Officer James Curtis on behalf of their deceased son; and,

WHEREAS, in contribution to the settlement of the lawsuit the Metropolitan Government is contributing sixty-two thousand five hundred dollars ($62,500) and Officer James Curtis is contributing two thousand five hundred dollars ($2,500); and,

WHEREAS, the Department of Law believes that the settlement is fair and reasonable, and recommends that this lawsuit be compromised and settled as to The Metropolitan Government of Nashville and Davidson County, and that said amount be paid out of the Judgment and Losses Fund.

Now, therefore, be it resolved by the Council of The Metropolitan Government of Nashville and Davidson County:

Section 1. That the Metropolitan Department of Law is authorized to compromise and settle the lawsuit of Jerry Hensley and Sue Hensley on behalf of the decedent, Jeffrey Hensley, against the Metropolitan Government in the amount of sixty-two thousand five hundred dollars ($62,500) Dollars, and that said amount should be paid from the Judgment and Losses Fund.

Section 2. This resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
