A resolution approving an amendment to a grant from the State of Tennessee, Department of Correction, to The Metropolitan Government of Nashville and Davidson County, acting through the State Trial Courts, for the implementation of a supervision and day reporting center.

Whereas, the State of Tennessee, Department of Correction, has awarded a grant in an amount not to exceed two million five hundred two thousand eight hundred seventy-nine dollars ($2,502,879) to the Metropolitan Government of Nashville and Davidson County, acting through the State Trial Courts for the implementation of a supervision and day reporting center and such grant was approved and accepted by The Metropolitan Council by ordinance (Bill No. BL2001-824); and,

Whereas, the parties amended the agreement by increasing the grant award, and the amendments were approved by resolutions of The Metropolitan Council (RS2002-924, RS2002-1191, RS2003-1382, and RS2003-95); and,

Whereas, the parties amended the agreement by decreasing the grant award, and the amendment was approved by resolution of The Metropolitan Council (RS2003-1568); and,

Whereas, the State of Tennessee, Department of Correction, has approved additional funding in the amount of $26,533.00, increasing the total amount of the grant from $2,546,826.00 to $2,573,359.00; and,

Whereas, the parties, by mutual agreement, wish to amend the grant by deleting paragraph C.1 in its entirety and replacing it with a new paragraph which changes the maximum annual liability for fiscal year three (July 1, 2003 through June 30, 2004), from $813,258.00 to $839,791.00 (an increase of by $26,533.00), and thereby increases the maximum liability of the State under this Grant to Two Millions, Five hundred Seventy-Three thousand, Three Hundred and fifty-Nine Dollars ($2,573,359.00); and,

Whereas, the parties, by mutual agreement, wish to amend the contract by deleting Attachment II in its entirety and replacing it with a revised Attachment II; and,

Whereas, Bill No. BL2001-824 provided that this grant may be amended by resolution receiving 21 affirmative votes; and,

Whereas, it is deemed to be in the best interest of The Metropolitan Government that this amendment to the contract be approved.

Now, therefore, be it resolved by The Council of The Metropolitan Government of Nashville and Davidson County:

Section 1. That the amendment to the Grant by and between the State of Tennessee, Department of Correction and The Metropolitan Government of Nashville and Davidson County, acting through the State Trial Courts, which amendment provides for an increase of $26,533.00 in funding, increasing the total grant from $2,546,826.00 to $2,573,359.00 and for the replacement of Attachment II, a copy of which amendment is attached and incorporated herein by reference, is hereby approved, and the Metropolitan Mayor is authorized to execute the same.
Section 2. That this Resolution shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
