RESOLUTION NO. RS2004-201

A resolution requesting the Davidson County Delegation to the Tennessee General Assembly to introduce and enact legislation to allow the Metropolitan Board of Public Education to select and purchase textbooks and other instructional materials of their choice.

WHEREAS, Tennessee Code Annotated §49-1-302 provides in part that the State Board of Education has the power and authority to “set policies governing all curricula and courses of study in the public schools” and to “prescribe the use of textbooks and other instructional materials, based on recommendations of the state textbook commission, for the various subjects taught or used in conjunction with the public schools”; and

WHEREAS, Tennessee Code Annotated §49-6-2207 provides that local boards of education are required to adopt textbooks from the list of textbooks listed for adoption by the State Textbook Commission; and

WHEREAS, local boards of education may only select textbooks not on the list adopted by the State Textbook Commission if they obtain a waiver based on the unique or unusual needs of the school system; and

WHEREAS, it is fitting and proper that the Metropolitan Board of Public Education be permitted to select textbooks which the board feels are best suited to educate the children of Nashville and Davidson County, regardless of whether or not the textbook is on the list adopted by the State Textbook Commission.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That the Metropolitan County Council hereby goes on record as requesting the Davidson County Delegation to the Tennessee General Assembly to introduce and enact legislation to allow the Metropolitan Board of Public Education to select and purchase textbooks and other instructional materials of their choice.

Section 2. The Metropolitan Clerk is directed to send a certified copy of this Resolution to each member of the Davidson County Delegation to the Tennessee General Assembly.

Section 3. This Resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
