RESOLUTION NO. RS2004-185

A resolution approving the compromise and settlement of the lawsuit of Marco Golliday, a minor, by and through his next friend, Bessie Brown, against the Metropolitan Government for the amount of Seventy Five Thousand ($75,000.00) Dollars, and directing that this amount be paid from the Self-Insured Liability Fund.

WHEREAS, On April 12, 2002, Marco Golliday, a minor, was struck by a hit-and-run automobile after exiting a Metropolitan Government Parks vehicle and attempting to cross the street unescorted to his residence, thereby causing personal injury to the said Marco Golliday; and,

WHEREAS, as a result of this accident, Marco Golliday filed a lawsuit against the Metropolitan Government, and the unknown driver and owner of the hit-and-run vehicle, by and through uninsured and underinsured motorist coverage applicable, and in favor of the said Marco Golliday; and,

WHEREAS, in contribution to the settlement of the claim against all defendants, the Metropolitan Government has reached a settlement in favor of the said Marco Golliday in the amount of Seventy Five Thousand ($75,000.00) Dollars; and,

WHEREAS, after a thorough investigation of this accident, the Department of Law believes that the settlement set forth in Section 1 below is fair and reasonable, and recommends that this lawsuit be compromised and settled as to The Metropolitan Government of Nashville and Davidson County, and that said amount be paid out of the Self-Insured Liability Fund.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. The Metropolitan Department of Law is authorized to compromise and settle the lawsuit of Marco Golliday against The Metropolitan Government of Nashville and Davidson County for the amount of $75,000.00, and that said amount should be paid to “Marco Golliday, a minor, by next friend, Bessie Brown” (great grandmother), and that said amount be paid from the Self-Insured Liability Fund.

Section 2. This resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
