RESOLUTION NO. RS2004-183

A resolution approving an interlocal agreement by and between the Metropolitan Government and the Emergency Communications District providing that the Metropolitan Government will handle procurements for the Emergency Communications District through the Purchasing Division of the Department of Finance.

WHEREAS, the Emergency Communications District of Metropolitan Nashville and Davidson County (ECD) was created by Ordinance No. 088-609 as authorized by Tennessee Code Annotated (T.C.A.) § 7-86-105; and

WHEREAS, ECD must procure goods and services from time to time, but it has no dedicated staff personnel to procure goods and services on a regular basis; and

WHEREAS, T.C.A. § 7.86-106 grants ECD the status of a municipality under Tennessee law; and

WHEREAS, T.C.A. § 12-9-104 grants Tennessee municipalities authority to enter into interlocal agreements to achieve common objectives by resolution; and

WHEREAS, the Metropolitan Government has entered into interlocal agreements in 1996 and 1998 with ECD whereby the Purchasing Division procured specific equipment and systems for ECD at ECD’s expense; and

WHEREAS, the Metropolitan Government has offered to make all procurements on behalf of ECD so long as ECD funds the purchases and reimburses the Metropolitan Government for the incidental costs of the Purchasing Division; and

WHEREAS, the ECD Board of Directors approved the attached Interlocal Agreement at its meeting of January 15, 2004.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That the attached Interlocal Agreement by and between The Metropolitan Government of Nashville and Davidson County and ECD whereby the Purchasing Division of the Metropolitan Department of Finance will procure goods and services for ECD, such purchases to be funded by ECD as well as the incidental costs incurred by the Purchasing Division on ECD’s behalf, be and the same is hereby approved and the Mayor is hereby authorized to execute the Interlocal Agreement.

Section 2. That this resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
