RESOLUTION NO. RS2004-122


A resolution recognizing Judge Ben H. Cantrell on his retirement from service with the Tennessee Court of Appeals.


WHEREAS, on September 1, 2003, Judge Ben H. Cantrell officially retired from service as Judge of the Tennessee Court of Appeals, Middle Section; and

WHEREAS, Judge Cantrell is a lifelong resident of Tennessee, a graduate of Palmersville High School, attended Bethel College, earned a Bachelor’s degree from Vanderbilt University and received his J.D. degree from the University of Tennessee College of Law; and

WHEREAS, while attending law school, he was a member of the Order of the Coif; and

WHEREAS, before being appointed Judge to the Tennessee Court of Appeals Ben H. Cantrell served in private practice and in 1973 as chancellor of Part 1 of the Seventh Chancery Division of the Metropolitan Government of Nashville and Davidson County; and

WHEREAS, Judge Cantrell heard many cases dealing with the operation of state and local government as Davidson County Chancellor; and

WHEREAS, Judge Cantrell was appointed to the Tennessee Court of Appeals in 1980, by Governor Lamar Alexander; and

WHEREAS, over the past 23 years Judge Cantrell has presided over numerous cases where he utilized his knowledge, dedication and professionalism, all of which will be sorely missed; and

WHEREAS, Judge Cantrell is known for being fair and tough, and he has followed his principles according to the law when performing his duties, but he is also memorably and fondly known for his wry sense of humor and very generous with his time; and

WHEREAS, Judge Cantrell is an active and important part of his community and profession, as a member of both the Nashville, Tennessee and American Bar Association; American Judicature Society; the Harry Phillips American Inn of Court; past presiding judge of the Court of the Judiciary, chaired the Tennessee Judicial Ethics Committee, the author of several published articles in the Tennessee Law Review and an instructor at the Nashville School of Law; and

WHEREAS, it is fitting and proper that the Metropolitan Council recognizes Judge Ben H. Cantrell for his many years of service and commitment to the citizens of Tennessee, and congratulate him on his well-deserved retirement as Judge, with best wishes for many years of happiness and contentment.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. The Metropolitan Council hereby goes on record as recognizing Judge Ben H. Cantrell on his retirement from service with the Tennessee Court of Appeals.

Section 2. The Metropolitan Council Office is directed to prepare a copy of this Resolution to be presented to Judge Ben H. Cantrell.

Section 3. This Resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
