RESOLUTION NO. RS2003-88


A resolution requesting the Metropolitan Police Department to enforce the Metropolitan Code provisions prohibiting the collection of garbage during certain hours.


WHEREAS, Section 10.20.300 of the Metropolitan Code of Laws provides in part that no person shall empty or remove any containers used for the accumulation or handling of garbage or rubbish between the hours of 11:00 p.m. and 7:00 a.m. when said containers are located within 300 feet of a residential structure except in the CC and CF zoning districts; and

WHEREAS, Section 8.202 of the Metropolitan Charter and Section 2.44.020 of the Metropolitan Code of Laws provide that the Metropolitan Police Department shall be responsible within the area of the Metropolitan Government for the enforcement of ordinances of the Metropolitan Government; and

WHEREAS, there is a lack of enforcement regarding the prohibition against collecting trash in residential areas between the hours of 11:00 p.m. and 7:00 a.m., which results in a disturbance to the residents; and

WHEREAS, it is fitting and proper that the Metropolitan Police Department enforce the Metropolitan Code provisions prohibiting the collection of garbage during certain hours.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That the Metropolitan County Council hereby goes on record as requesting the Metropolitan Police Department to enforce the Metropolitan Code provisions prohibiting the collection of garbage during certain hours.

Section 2. The Metropolitan Clerk is directed to send a certified copy of this Resolution to acting Police Chief Deborah Faulkner.

Section 3. This Resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
