RESOLUTION NO. RS2003-82

A resolution compromising and settling the restoration portion of the claim of Billy R. Johnson against The Metropolitan Government of Nashville and Davidson County for an amount not to exceed $21,753.67 and directing that this amount be paid out of the Self-Insured Liability Fund.

Whereas, on September 22, 2003, claimant sustained property damage caused by a blockage in a main sewer line that is owned and maintained by the Metropolitan Government which resulted in sewage backing up in claimant’s duplex; and,

Whereas, after investigation, the Department of Law believes that the settlement listed in Section 1 is fair and reasonable and in the best interest of the Metropolitan Government, and recommends that the claim be compromised and settled for an amount not to exceed $21,753.67, and that this amount be paid from the Self Insured Liability Account.

Now, therefore, be it resolved by the Council of The Metropolitan Government of Nashville and Davidson County:

Section 1. That the Metropolitan Department of Law is authorized to compromise and settle the claim of Billy R. Johnson against the Metropolitan Government for an amount not to exceed $21,753.67. Said amount should be paid out of the Self-Insured Liability Fund.

Section 2. That this resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
