RESOLUTION NO. RS2003-80

A resolution accepting payment to The Metropolitan Government of Nashville and Davidson County in the amount of $48,136.54 and authorizing the Metropolitan Department of Law to settle the subrogation claim of the Metropolitan Government against Henry S. Tarpley.

Whereas, Henry S. Tarpley was an employee of the Metropolitan Fire Department and was involved in a motor vehicle accident on August 29, 2000 while in the course and scope of his employment, resulting in personal injury and ultimate employment disability; and

Whereas, The Metropolitan Government of Nashville and Davidson County has received subrogation rights from said employee and through said employee for medical expenses, lost wages, and disability payments made by the Metropolitan Government; and

Whereas, the Metropolitan Department of Law believes that the settlement of Metro’s subrogation interests listed in Section 1 is fair and reasonable and recommends that Henry S. Tarpley’s subrogation obligation be compromised and settled and that said amount be paid to the The Metropolitan Government of Nashville and Davidson County.

Now, therefore, be it resolved by the Council of The Metropolitan Government of Nashville and Davidson County:

Section 1: The Metropolitan Department of Law is authorized to settle the subrogation claim of The Metropolitan Government of Nashville and Davidson County against Henry S. Tarpley for the amount of $48,136.54, which amount should be paid to The Metropolitan Government of Nashville and Davidson County.

Section 2: This resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
