RESOLUTION NO. RS2003-70

A resolution approving an amendment to extend, for four additional months, a lease agreement by and between The Metropolitan Government of Nashville and Davidson County, acting through the Police Department and Acton Mobile Industries, Inc. for a modular building for the training academy.

Whereas, the Police Department with the approval of the Metropolitan Council entered into this lease for a modular building with an option to buy after making forty-eight monthly rental payments (contract number 13600); and

Whereas, the original lease will expire before forty-eight rental payments are made due to a delay in getting the modular building in place; and

Whereas, the Police Department would like to exercise its option to purchase but must extend the lease in order to make the required forty-eight monthly rental payments; and

Whereas, Metropolitan Code 5.04.020 provides that all leases for equipment shall be approved by resolution if the annual expenditure exceeds $5,000.00 per year; and

Whereas, it is deemed to be in the best interest of The Metropolitan Government of Nashville and Davidson County to approve this amendment to contract number 13600.

Now, therefore, be it resolved by the Council of The Metropolitan Government of Nashville and Davidson County:

Section 1. That the amendment to extend, for an additional four months, the Lease Agreement by and between The Metropolitan Government of Nashville and Davidson County acting through the Police Department, and Acton Mobile Industries, Inc. for the lease of a modular building at a rental price of $580.00 per month with the option to purchase at the end of forty-eight months, a copy of which is attached hereto and incorporated herein, is hereby approved.

Section 2. That this resolution shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
