RESOLUTION NO. RS2003-46


A resolution requesting the Metropolitan Planning Commission to evaluate the current community education standards in the Zoning Code, and to recommend any modifications necessary to ensure such facilities receive appropriate review.


WHEREAS, community education uses are permitted with conditions (“PC”) in the Zoning Code;

WHEREAS, the Metro Council approves the location of new public schools, and any proposed expansion to them, through the Metropolitan Government’s Capital Improvements Budget;

WHEREAS, the location of new schools and expansion of existing schools, whether public or private, is a community-wide benefit, such facilities do generate increased traffic, noise, lighting, parking, and access concerns for surrounding property owners and neighborhoods; and

WHEREAS, it is appropriate to evaluate whether our current zoning standards support Nashville’s neighborhoods without adversely affecting them.

NOW, THEREFORE, BE IT RESOLVED BY THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That the Metropolitan County Council hereby goes on record as requesting the Metropolitan Planning Commission to evaluate the current community education standards in the Zoning Code, and to recommend any modifications necessary to ensure such facilities receive appropriate review.

Section 2. The Metropolitan Clerk is directed to send a certified copy of this Resolution to the Executive Director and each member of the Metropolitan Planning Commission.

Section 3. That the Executive Director and members of the Metropolitan Planning Commission are further requested to inform the Metropolitan Council of the feasibility and/or the actions taken in compliance with the request contained in Section 1 hereof, not later than ninety (90) days after the adoption of this Resolution.

Section 4. This Resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.

Amendment No. 1

To

Resolution No. RS2003-46

Mr. President:

I move to amend Resolution No. RS2003-46 by adding the following provisions to Section 1:

"The Metropolitan Planning Commission is further requested in this evaluation to hold public hearings and meetings to allow educational and public participation. The Metropolitan Planning Commission shall give adequate public notice to the public in general of such hearings and/or meetings with specific notice being provided to the Director of Schools, the principals of all schools of the Metropolitan Board of Public Education, and to the head of the Independent Schools of the Nashville Area".

Amendment No. 2

To

Resolution No. RS2003-46

Mr. President:

I move to amend Resolution No. RS2003-46, as amended, by further amending Section 1 by inserting after the amended provisions "the principals of all schools of the Metropolitan Board of Public Education," and before the phrase "and to the head of the Independent Schools of the Nashville Area", the following phrase:

"to the Members of the Metropolitan County Council,"

Mr. President:

I move to amend Resolution No. RS2003-46, as amended, by further amending Section 1 by adding at the end of such section the following new sentence:

“Notice shall also be given to each resident within five hundred (500) feet of any current community education facility.”
