SUBSTITUTE RESOLUTION NO. SRS2000-242
A substitute resolution authorizing the Metropolitan Department of Law to compromise and settle the claim of Walter Hooks against The Metropolitan Government of Nashville and Davidson County for the sum of $11,500.
Whereas, on June 26, 1999, Mr. Langston was driving a Water Services truck west on Jefferson Street, and slowed to prevent hitting a car that was exiting a parking lot. While Mr. Langston was observing this car, Mr. Hooks stopped his vehicle in front of Mr. Langstons truck, and Mr. Langston was unable to stop in time. The truck driven by Mr. Langston hit the rear of Mr. Hooks car. Liability is clearly upon Metro in this matter; and
Whereas, a lawsuit was filed by Mr. Hooks in the Sixth Court for Davidson County, Tennessee; and
Whereas, after investigation, the Department of Law believes the settlement amount as set forth in Section 1 is fair and reasonable and recommends that this case be compromised and settled and that the amount of $11,500 be paid from the Self-Insured Liability Fund.
Now, therefore, be it resolved by the Council of The Metropolitan Government of Nashville and Davidson County:
Section 1. The Department of Law is authorized to compromise and settle the lawsuit of Walter Hooks v. Metropolitan Government, No. 99C2938, for the sum of $11,500, said amount to be paid from the Self-Insured Liability Fund.
Section 2. This resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
